As an appellate practitioner, and as the Supervising Attorney of the Appellate Unit of the Union County Prosecutor's Office for twenty-three years, I have argued seventeen cases before the New Jersey Supreme Court, two cases before the United States Court of Appeals for the Third Circuit and hundreds of cases before the New Jersey Appellate Division. I have also argued innumerable motions and municipal appeals before the trial courts.
Among the cases I argued before the New Jersey Supreme Court on behalf of the State of New Jersey were State v. Gilmore, 103 N.J. 508 (1986), the key case in New Jersey for determining the validity of prosecutorial peremptory jury challenges, State v. Davis, 104 N.J. 490 (1986), the seminal case in New Jersey on investigative detentions, and State v. Cannon, 128 N.J. 546 (1992), in which the Court was compelled by the State's arguments to recognize that one of its own sentencing programs, the ISP program, needed to be reconstituted. In addition, in 2007, I successfully argued on the State's behalf in the capital-murder case of State v. Francis, resulting in a reversal by the Supreme Court of the judgments of the Appellate Division and the trial court that had supressed vital grand jury evidence secured by the State.
